Terms and Conditions for the Auto-invest Plan

 

1. These terms and conditions for the Auto-invest Plan govern our provision of the Auto-invest Plan service (the “Auto-invest”). These Auto-invest terms supplement, and should be read together with, the Client Agreement and any other terms and conditions (including the FAQ regarding the Auto-invest which may be found on our website) regarding the services provided by Tiger Brokers (AU) Pty Limited (hereinafter referred to as “we” or “us”), as they may be amended from time to time. In the event of any conflicts between the Client Agreement and these Auto-invest terms, the latter shall prevail. Unless otherwise specified, all capitalized terms used in these Auto-invest terms shall have the same meanings given to them in the Client Agreement.

 

2. You must open an account for the purpose of settling payments in relation to the Auto-invest before you may set up an Auto-invest Plan.

 

3. The gross periodic investment for the Auto-invest Plan (the “Contribution”) will be debited from your account according to clause 2 above at such date(s) and frequency as determined by your Auto-invest Plan (the “Specified Time”). Subject to these Auto-invest terms, we will execute your Auto-invest Instructions by purchasing the relevant stocks/ETFs at the Specified Time. Notwithstanding the foregoing, we have the right to amend the Specified Time from time to time without prior notice to you. If the Specified Time is not on a Trading Day, the corresponding Instruction will be executed on the next Trading Day and the Contribution will be debited upon the completion of execution.

 

4. You shall ensure that there are sufficient available funds of the relevant currencies in your account to pay the Contribution at the Specified Time.

 

5. You may cancel the auto-invest order at any time, unless the auto-invest plan is being processed at the time of your cancellation and half an hour before the execution of auto-invest order. Auto-invest plan instructions will not be cancelled by TBAU unless notified by you via the TBAU platform.

 

6. Subject to any Applicable Regulations, we may, without notice to you, aggregate your orders/Contributions with those of our own, or with those of persons connected with us, or with those of our other clients. Such aggregation may on some occasions operate to your disadvantage and on others to your advantage.

 

7. TBAU reserves the right to restrict the terms and conditions of any auto-invest plans at any time in connection with fulfilling its regulatory and legal Obligations.

 

8. TBAU will send you a push and in-app notification 2 calendar days (ET) before the execution of each auto-invest order. TBAU will send a corresponding push or message if auto-invest-order is filled or cancelled.

 

9. Your Auto-invest Plan and each Contribution are subject to any fees or charges that we may impose from time to time.

 

10. The stocks/ETFs eligible for investment under the Auto-invest Plan are subject to change and shall be determined by us at our absolute discretion from time to time.

 

11. Without prejudice to any other clauses, we may not be able to execute your Instructions (or any part of them) in respect of the Auto-invest Plan at a Specified Time (or at all) due to reasons including but not limited to: there being insufficient funds in your account or the funds do not meet the order's requirements , there being trading restrictions on your account; the relevant stock/ETF having poor liquidity; the relevant stock/ETF ceasing to be publicly traded or being suspended for trading; closure or suspension of the relevant Exchange(s); inclement weather; under emergency situations; or otherwise, and we shall not be liable for any losses or any other consequences incurred thereof.

 

12. Notwithstanding anything to the contrary, we reserve the right to, at any time, without any notice or reason:
1. impose or amend any maximum or minimum limit of each Contribution;
2. refuse to execute any Instruction under the Auto-invest Plan;
3. modify or discontinue, temporarily or permanently, the Auto-invest Plan service; and/or
4. suspend or terminate, temporarily or permanently, your Auto-invest Plan.
