New York Times Countersues US Federal Employment Agency, Alleging Political Retaliation Through Discrimination Lawsuit

The New York Times has formally filed a countersuit in Manhattan federal court against the U.S. Equal Employment Opportunity Commission (EEOC), accusing the federal agency of unlawful retaliation.

The newspaper asserts that a prior lawsuit brought by the EEOC alleging racial and gender discrimination was, in essence, an abuse of authority and an act of malicious retribution for the paper's news reporting.

In its legal filing, the New York Times explicitly states that the EEOC violated the First and Fifth Amendments of the U.S. Constitution.

The paper's countersuit emphasizes that due to the Trump administration's hostility towards the New York Times' protected newsgathering, reporting, and speech, the commission subsequently targeted the newspaper for adverse treatment.

Furthermore, the New York Times strongly questions the timing of the agency's original lawsuit, pointing out that it was filed just days after the newspaper published an article criticizing the EEOC and its leadership for receiving widespread condemnation.

This legal dispute originates from a lawsuit filed by the EEOC in May of this year.

The agency had claimed that in early 2025, during the selection process for a deputy real estate editor position, the New York Times declined to promote senior white male editor Bryant Rousseau due to race and gender, instead hiring a less experienced external candidate who was a non-white woman.

Rousseau subsequently filed a discrimination complaint with the commission and resigned from the New York Times in June.

In response, the New York Times firmly denies these allegations in its countersuit and issued a statement reiterating that its hiring practices are strictly merit-based and dedicated to recruiting and promoting the world's best talent.

The paper noted that the ultimately hired candidate was fully qualified for the role and possessed more extensive experience in service journalism.

Regarding Rousseau individually, the New York Times emphasized that he had received a promotion since joining in 2014 and that in 2024, the paper had offered him at least two positions aligned with his stated career goals.
