The U.S. Commodity Futures Trading Commission (CFTC) has formally submitted a motion to the U.S. District Court for the District of Columbia, requesting the dismissal of a civil lawsuit filed by CME Group Inc (CME.US). The core of this dispute revolves around the legal classification of crypto-asset contracts.

The conflict stems from the CFTC's June approval allowing prediction market platform Kalshi to offer perpetual contracts tied to the spot price of Bitcoin (BTC), as well as its decision not to intervene in similar products offered by cryptocurrency exchange Coinbase (COIN.US). Following this, CME Group Inc initiated legal action, accusing CFTC Chairman Michael Selig of acting unilaterally without a collective decision from the five commissioners, and of treating "futures" contracts with a maturity date as "swaps," which allegedly violates the Commodity Exchange Act.

In its filing on Wednesday, the CFTC countered that CME Group Inc has not claimed it is unable to launch comparable futures contracts itself, thereby rendering its argument of incurred losses moot. The CFTC further argued that CME Group Inc lacks the legal standing to bring the suit, and referenced a previous statement to Cointelegraph in which the regulator characterized CME Group Inc's action as a "lawfare" tactic, labeling its June complaint as "ridiculous."

Where to begin, the regulatory body emphasized that CME Group Inc has failed to demonstrate it suffered material harm due to the CFTC's policy announcements, and noted that the exchange has the inherent capability to develop similar products, concluding the lawsuit lacks a legal foundation.

Presently, Selig and the CFTC are requesting an oral hearing to consider the motion to dismiss. However, as of Thursday, no hearing time has been scheduled on the official calendar. This procedural delay highlights the regulator's strategic considerations in facing challenges from traditional financial giants and foreshadows a more prolonged judicial tug-of-war over regulatory authority concerning crypto derivatives.
