Flexible Workers Urged to Join Employee Medical Insurance as China's Gig Workforce Surpasses 200 Million

China's legislative authority has taken a significant step to broaden healthcare coverage for its expanding gig economy workforce. The Standing Committee of the 14th National People's Congress passed the landmark Healthcare Security Law on August 28, 2026, which explicitly encourages flexible workers to enroll in the employee basic medical insurance system. The law targets independent contractors without hired staff, part-time workers not covered by their employers, and other non-traditional employees, with implementation details to be developed by the State Council's healthcare security administration in coordination with relevant departments.

China operates two main categories of basic medical insurance: employee medical insurance and resident medical insurance, which is formally known as basic medical insurance for urban and rural residents. According to the "2025 National Healthcare Security Development Statistical Bulletin" released by the National Healthcare Security Administration in July 2026, the country's total basic medical insurance enrollment reached 1.3307 billion people by the end of 2025, maintaining a coverage rate of 95%. Of this total, 388.56 million individuals were enrolled in employee medical insurance, while 942.13 million participated in resident medical insurance. Notably, only 69.82 million flexible workers and other non-standard employees opted for the employee medical insurance scheme.

This participation figure stands in stark contrast to the estimated 200 million people currently engaged in flexible employment across China. The substantial gap indicates that a significant portion of gig workers have chosen resident medical insurance instead, or remain entirely uninsured. Yu Baorong, a professor at the Insurance School of the University of International Business and Economics, explained that flexible workers form a diverse demographic that technically has the option to participate in either insurance system. Their decision, according to Yu, typically hinges on a practical comparison between financial obligations and potential benefits, weighing premium costs against coverage levels. The new law's endorsement of employee medical insurance for this group signals a clear national policy direction encouraging flexible workers to prioritize the more comprehensive employee-based coverage.

The new statutory provision marks the first time the healthcare security legal framework has specifically addressed the insurance choices of gig economy participants.
