Updated E-commerce Law Draft Seeks Public Input to Clarify Rights and Duties in Platform Economy

To thoroughly implement the Central Committee and State Council's decisions on the platform economy, better protect the lawful rights and interests of all parties in e-commerce, further regulate the conduct of e-commerce platform operators, and promote the sustained and healthy development of e-commerce, the State Administration for Market Regulation and the Ministry of Commerce have recently drafted the "E-commerce Law of the People's Republic of China (Revised Draft for Comments)" and are now soliciting public feedback.

The revised draft for comments consists of twenty articles, with main content covering five key areas. First, it expands the scope of legal regulation. Building on the current framework covering platforms and operators within platforms, it further clarifies the rights and obligations of other participants in the platform economy.

Second, it improves the platform responsibility system. Beyond the existing fixed-amount fines and orders to suspend business for rectification, it enriches regulatory measures to support normalized oversight.

Third, it establishes a coordinated working mechanism for supervision. In response to the cross-border and mixed operations of the platform economy, it adds the principle of consistent management for online and offline business lines, strengthening coordinated departmental and central-local integrated supervision.

Fourth, it standardizes prominent illegal activities in e-commerce. Focusing on issues that have drawn strong public concern in practice, it revises and improves corresponding clauses to effectively address societal concerns.

Fifth, it deepens e-commerce openness and cooperation. It promotes the alignment and compatibility of e-commerce rules, regulations, management, and standards with international norms, strengthens industry self-discipline, guides orderly overseas expansion, increases countermeasures against external actions, and safeguards the lawful rights and interests of enterprises.

In the next step, the State Administration for Market Regulation and the Ministry of Commerce will refine the revised draft based on the feedback received from the public consultation and work to expedite the amendment and promulgation of the E-commerce Law of the People's Republic of China, laying a solid legal foundation for innovation and healthy development in the platform economy.
