Shanxi Raises Minimum Wage Threshold, Boosting Additional Benefits for Workers

Starting October 1, 2026, Shanxi Province will implement adjustments to its minimum wage standards, with the new rates varying across the region's counties and districts.

Under the revised framework, the urban district of Luzhou and Xiangyuan County in Changzhi City will see their minimum wage set at the first-tier level of 2,350 yuan per month. The districts of Lucheng, Shangdang, and Tunliu, along with Qinyuan County and Zhangzi County, will be classified under the second-tier standard at 2,250 yuan. Meanwhile, Pingshun, Qin, Wuxiang, Huguan, and Licheng counties are designated for the third-tier rate of 2,150 yuan.

The Minimum Wage Regulations stipulate that when determining and adjusting monthly minimum wage levels, local authorities must consider factors such as the basic cost of living for employed persons and their dependents, the urban consumer price index, employees' social insurance contributions and housing fund payments, average wages, economic development levels, and employment conditions. Typically, regions adjust these standards every two to three years.

The upward revision of the minimum wage directly boosts the income of low-wage earners, but its impact extends further, influencing the labor rights and interests of other workers as well.

"The calculation benchmarks or minimum safeguards for overtime pay, unemployment insurance benefits, probationary wages, economic compensation, standby wages for dispatched workers, and sick leave pay are all linked to the local minimum wage to varying degrees," noted Lu Jingbo, deputy director of the Labor and Social Security Law Committee of the All-China Lawyers Association.

Taking overtime pay as an example, Lu elaborated: "Overtime compensation is calculated based on an employee's normal working hours' wage, and the regulations clearly state that the minimum wage does not include overtime pay. When an employee's salary is at the minimum wage level, overtime pay will increase in tandem with the minimum wage."

Furthermore, regarding probationary wages, the Labor Contract Law mandates that wages during the probation period cannot fall below the local minimum wage standard. Additionally, sick leave pay or disease relief funds during the medical treatment period must not be less than 80% of the minimum wage standard.

Why businesses may attempt to circumvent the rules

Despite the favorable policy changes, some enterprises still seek ways to sidestep minimum wage protections, infringing on workers' rights. These tactics include incorporating overtime pay and position allowances into the minimum wage calculation under a "package salary system," offsetting the minimum wage with free meals, accommodation, meal and housing subsidies, or transportation allowances, and counting allowances for high-temperature, night shift, underground, or toxic and hazardous work as part of the minimum wage.

Lu advises that workers facing such situations should first secure evidence by retaining their labor contracts, salary structure documents, and payroll records. Next, they can file a complaint with the labor inspection authorities, who, upon verification, will order the employer to make up the shortfall within a specified period. Additionally, workers may apply for labor arbitration to claim the difference in minimum wage.

The minimum wage standard serves as a fundamental baseline for labor rights. Relevant authorities must strengthen employment supervision, ensure smooth channels for rights protection, and strictly investigate all forms of disguised violations. Workers should also proactively familiarize themselves with policy standards, clearly understand their own rights, remain vigilant against corporate non-compliance, and promptly seek recourse when encountering wage deductions or unmet standards.
