Sony Faces Legal Challenge as Gamers Highlight Past 'Ownership' Promises

Sony Interactive Entertainment (SIE) is currently facing a class-action lawsuit over the issue of digital game "ownership," with the company's legal team arguing that a "rational consumer" should understand that buying a digital game on PlayStation does not equate to actually owning the title. While this legal stance may hold up in a court of law, the plaintiffs have compiled a list of past official statements from Sony that used wording such as "Own" and "Owned," suggesting these promotional materials directly contradict the company's current defense.

The plaintiffs point to specific examples where Sony appeared to promise ownership to consumers. For instance, Sony previously stated that "if a player already owns the PS4 version of a game, they do not need to purchase the PS5 version." Additionally, the PlayStation Network (PSN) review system refers to players as "verified owners of the game or product," further reinforcing the perception that consumers believe they are purchasing the software outright.

While Sony does outline the licensed nature of digital games within its lengthy terms of service, the plaintiffs argue that the company rarely clarifies this point through footnotes or other prominent disclosures. As a result, consumers are left to believe that their "ownership" refers to holding the software itself, rather than receiving a license for a digital copy. This perceived lack of transparency could give the plaintiffs a stronger chance of overturning the case in their favor.

Ultimately, the outcome of this lawsuit remains uncertain, and it will be up to the court to determine whether Sony's historical messaging constitutes a binding promise of ownership or simply a casual use of language.
