A woman in Shaanxi who died after falling from a hotel window in the early hours following a night of heavy drinking has prompted a court to order the hotel to pay 110,000 yuan to her family. The deceased, identified as Zheng, had been drinking with friends before being escorted to a hotel room, where she later ran out barefoot and was found dead the next morning on a fourth-floor platform.

According to the second-instance judgment published by the Hanzhong Intermediate People's Court on September 23, the hotel was found to have both facility defects and management negligence, while the victim was deemed primarily responsible for her own death. The court upheld the original ruling, requiring the hotel to compensate Zheng's parents and son more than 110,000 yuan in total damages, against the family's initial claim of over 500,000 yuan.

The Incident and the Family's Claim

Court documents show that on the evening of November 29, 2025, Zheng attended a hotpot dinner with friends where she consumed liquor, and later moved on to a KTV session where she also drank beer. Around 10 p.m., after the singing session ended, several friends escorted her to a hotel. Because she refused to go to her room, the group first helped her rest in the lobby lounge before eventually moving her to room 809 on the eighth floor, where multiple people stayed to watch over her.

Around 12:30 a.m., most companions left, leaving only one friend surnamed Zhang to accompany Zheng. About an hour later, at 1:20 a.m., she suddenly ran out of the room barefoot. Surveillance footage captured her entering the elevator lobby, then moving to the stairwell where she went down to the seventh floor only to quickly return upstairs. She later attempted to open a door leading to the rooftop on the ninth floor, but failed. After briefly lingering, she descended to the eighth floor where she opened a window and leaned out before closing it again, then went down to the seventh floor, after which she disappeared from camera view.

Zhang contacted other friends to join the search, and together with hotel security staff, they combed the building for hours. Around 4 a.m., with no sign of Zheng, the friends left, Zhang returned to room 809 to sleep, and the security guard resumed his post at the lobby. At 7 a.m., Zhang and another friend continued searching by reviewing surveillance footage. At 8 a.m., a hotel cleaner discovered Zheng's body on a platform outside the fourth floor. Police responding to the scene found barefoot footprints on the windowsill of the seventh-floor fire passage that matched the deceased, with no signs of accompanying or alternating footprints, leading them to conclude Zheng died from a fall and no criminal case was established.

Zheng's parents and adult son subsequently reached settlements with the companions who had been drinking with her, receiving partial compensation. However, failing to reach an agreement with the hotel operator, they took the case to court seeking total damages exceeding 500,000 yuan for funeral expenses, mental distress, and other losses.

The Court's Assessment of Fault

The first-instance court established that Zheng, born in 1978, was a fully capable adult. The building containing room 809 has nine floors, with surveillance cameras installed in corridors on floors five through nine, but notably no cameras on the sixth and seventh floors. The court held that as the primary person responsible for her own safety, Zheng should have anticipated the risks of impaired judgment and reduced impulse control from drinking, and her voluntary climbing and falling from the window made her bear the main responsibility.

At the same time, the hotel was found to have failed in its duty of care. The stairwells on the sixth and seventh floors lacked monitoring, preventing both staff and companions from tracking Zheng's movements during the multi-hour search. More critically, the hotel, clearly aware that a drunk guest was missing and in a foreseeable state of danger, took no effective emergency measures—neither contacting police, notifying family, nor expanding the search scope—instead allowing the dangerous situation to continue until the body was discovered the next morning.

The court determined the hotel's passive handling and facility shortcomings, while not being the direct cause of the fall, had cut off the possibility of preventing danger and providing timely rescue, making them a secondary and indirect cause of the harm. The first-instance judgment calculated total losses at 1,176,248.5 yuan and held the hotel liable for 10 percent, or 117,624.85 yuan. The hotel appealed, arguing factual errors, but the second-instance court upheld the ruling in early September, stating that the discretionary liability scale was fair and appropriate.
