Regulatory Bodies Convene to Strengthen Multi-Party Resolution Framework for Financial Disputes

Financial regulators have recently joined forces with the central bank and securities watchdog to advance collaborative efforts in resolving financial consumer and investor disputes.

The National Financial Regulatory Administration, together with the People's Bank of China and the China Securities Regulatory Commission, hosted the fifth liaison meeting on consumer and investor protection oversight, with the Supreme People's Court and the Ministry of Justice also in attendance.

The session centered on enhancing the multi-faceted dispute resolution mechanism, with an emphasis on reinforcing cross-departmental coordination to boost the effectiveness and efficiency of handling financial conflicts.

During the discussions, it was highlighted that financial authorities have been implementing central government directives by adopting the "Fengqiao Experience" approach suited to contemporary needs. With institutional backing from relevant departments, a four-in-one framework has been developed, integrating complaint handling by financial institutions, neutral mediation through industry bodies, regulatory supervision and governance, as well as the linkage between arbitration and litigation with mediation.

This comprehensive model offers substantial support for tackling the root causes of disputes in the financial sector and ensuring effective resolution of conflicts.

The meeting also underscored the need for continuous improvement to the existing mechanisms. Regulators are expected to intensify efforts in addressing disputes at their source, utilizing a broad spectrum of supervisory instruments to compel financial institutions to embed consumer and investor protection measures into every stage of their operations.

Working alongside relevant authorities, plans are in place to deepen the "head-to-head" interface between mediation and both litigation and arbitration. This includes streamlining procedures for empowering mediation agreements with enforcement strength, refining supporting transitional processes, and facilitating early and substantive resolution of conflicts.

Furthermore, greater emphasis will be placed on publicizing these dispute resolution avenues, establishing a multi-layered and multi-channel promotional campaign. The objective is to educate the public on the advantages of non-litigation methods, using practical cases to illustrate legal principles and reasoning, thereby fostering a social environment that prioritizes mediation and lawful dispute settlement.
