Atrum Coal (ASX:ATU) delivered an application for permission to file an amended statement of claim in a court in Alberta against the government of Alberta regarding unit Elan Coal's leases, according to a Monday Australian bourse filing.
Atrum and Elan Coal brought a claim against the government of Alberta in September 2022 for allegedly de facto expropriating Elan's coal leases, with the firms seeking monetary compensation.
The amended claim was prepared after a Jan. 15 ministerial order in Alberta which rescinded the moratorium on coal exploration and development in Alberta but incorporated a prohibition on open-pit
mining.
Elan's coal leases can only be developed via open-pit mining, the filing said.
The case is set to go to trial by April 28.
