Bayer Asks Supreme Court to Review Roundup Case

Bayer filed for the Supreme Court to review a lower court's decision on a case alleging the company's Roundup product caused cancer.

Bayer said Friday it had filed a petition for a writ of certiorari with the Supreme Court, arguing that a split among federal circuit courts in the Roundup litigation warrants review and resolution by the top court.

In 2023, a Missouri Circuit Court returned a verdict in favor of John Durnell, who alleged the weed control product Roundup caused non-Hodgkin's lymphoma. Bayer bought the agrochemical company Monsanto, which makes Roundup, in 2018.

The Missouri court's verdict rests on the claim that state law requires companies to warn if their products are carcinogenic, Bayer said.

Different courts have reached different conclusions, which is why Bayer is arguing the Supreme Court needs to rule on the issue.

Tens of thousands of Roundup cases are pending in state and federal courts. The ongoing litigation threatens Monsanto's ability to supply glyphosate-based products, Bayer said.
