A Canadian court has ordered NOVA Chemicals Corporation to pay Dow Inc. an additional CAD$1.620 billion (approximately USD$1.2 billion) in damages. This judgment, issued by the Court of King's Bench of Alberta, relates to losses Dow incurred from a jointly owned ethylene asset in Joffre, Alberta. The latest ruling follows a previous payment of CAD$1.43 billion (approximately USD$1.08 billion) made by NOVA to Dow in 2019, after a 2018 decision found NOVA had not operated the ethylene asset at full capacity, breaching contractual obligations since 2001. The recent award includes interest up to April 7, 2025, excluding subsequent interest or legal costs, with payment expected in the fourth quarter of 2025. The judgment is subject to appeal.
