The motion contends that the District lacks the legal requirements to proceed with its lawsuit, which aims to transfer ownership of the Monterey Peninsula water system. California American Water, which has been operating the system for over 60 years, argues that the District does not possess the necessary approval from the Monterey County Local Agency Formation Commission to become a retail water provider. The company also highlights that the District has never operated a public water system and has spent over $3 million of local residents' funds on this legal effort. If successful, the motion will end the case in favor of California American Water.
