And if you've ever had a 360 Savings account, you could be entitled to a payout worth possibly hundreds or even thousands of dollars, depending on your balance and how long you kept it.Before we get into the details, here's the bottom line: if you still have a 360 Savings account, closing it by Oct. 2, 2025 could mean a much bigger check in your pocket.How the lawsuit startedCapital One's 360 Savings account launched years ago with a competitive 1.00% APY. But in 2019, the bank rolled out a nearly identical account -- called the 360 Performance Savings -- that paid almost double the rate at the time. The problem is that existing 360 Savings customers weren't told.As interest rates climbed in recent years, the gap only grew. By late 2020, 360 Savings balances were stuck at 0.30%, while new Performance accounts soared to more than 4.00%. A class-action lawsuit filed in 2024 accused Capital One of misleading savers and depriving them of billions in interest they should have earned.Where the case stands nowIn May 2025, Capital One agreed to settle for $425 million without admitting wrongdoing. A federal judge gave the settlement preliminary approval in July, and a final hearing is scheduled for Nov. 6, 2025. If it's approved, payments could start going out in early 2026.The Consumer Financial Protection Bureau had initially sued the bank earlier this year, calling its actions deceptive. But that case was dropped soon after President Donald Trump took office, leaving the class action as the main path for customers to recover money.Who's eligible and why closing your account mattersIf you had a 360 Savings account between Sept. 18, 2019, and June 16, 2025, you're automatically included in the settlement. No forms to file, no hoops to jump through.But here's the catch:Close your account by Oct. 2 and you'll qualify for about a 15% larger payout.Keep your account open past that date, and your payout shrinks. You'll also get a tiny \"boosted\" interest rate going forward: 0.78% APY. That's still a fraction of what you can get from top high-yield savings accounts paying 4.00% to 5.00% APY today.Put simply, it's almost always smarter to close the account, take the bigger payout, and move your money somewhere it can actually earn. For example, if you had $10,000 in a 360 Savings account from late 2019 until now, you could be looking at nearly $800 if you close before the Oct. 2 deadline. The longer and larger it's been, the bigger your payout.Close your 360 Savings account before Oct. 2. This unlocks the maximum cash settlement.Move your savings to a high-yield account. Don't settle for 0.30% or 0.78% APY when you can get 4.00%+ elsewhere.You don't need to do anything else to claim your money -- Capital One's records determine eligibility.
