The suit alleges that RetailNext has used key Alpha Modus inventions without authorization, specifically technologies covered by four U.S. patents related to real-time tracking of shopper behavior, store layout optimization, and integration of physical and digital insights. Alpha Modus claims that many core features of RetailNext's widely used analytics solutions infringe on these patents. RetailNext, a major player in retail analytics with clients including Macy's, Ulta, and Bloomingdale's, recently received significant investment backing and operates in over 100 countries. Alpha Modus states it is committed to protecting its intellectual property rights and is prepared to pursue the matter through litigation.
