Birchtech Corp. has received a decision from the U.S. District Court of Delaware increasing its judgment amount to approximately $78 million in a patent infringement case against major energy companies. The case, initially filed in 2019, involved 43 defendants, including major power utilities and refined coal companies. After a jury verdict in March 2024 found willful, inducing, and contributory infringement, the court awarded Birchtech a $57 million verdict, later increased to about $78 million with pre- and post-judgment interest. The company expects the judgment to accelerate the expansion of its market share and lead to new license agreements and supply contracts related to its patented mercury emissions capture technologies. A proposed final judgment is to be submitted by December 23, 2025.
