Structural Monitoring Systems to Remove Director, Terminate Agreement with Turton House Group After Court Decision

Structural Monitoring Systems (ASX:SMN) said the Federal Court of Australia decided not to grant an injunction in response to an application, and following the decision, the firm resolved that Ross Love be removed as a director and the agreement with Turton House Group, through which Love is engaged, be terminated, according to a Tuesday Australian bourse filing.

A formal complaint was received from the people and culture director at its Canadian unit, Anodyne Electronics Manufacturing, alleging serious workplace issues. After the consideration of a report from an investigation, which was conducted independently, as well as "Love's subsequent behavior," the firm's board determined that it was in the best interests of the firm to terminate Love's executive services agreement.

Love and Turton House Group brought proceedings against the company and units in the Federal Court in October, alleging that they had been subject to adverse action and victimization. The proceedings will continue.

The court also ordered that Love and Turton House Group pay the firm's costs incurred in connection with the injunction application.

Its shares advanced 1% in recent trading on Tuesday.
