Amazon Vows to 'Vigorously Challenge' German Regulator's 'Profit Disgorgement' Demand

Amazon.com (AMZN) confirmed Thursday Germany's Federal Cartel Office has ordered a 'profit disgorgement' of 59 million euros ($69.7 million) against it for an alleged attempt to thwart competition.

"We will vigorously challenge the FCO's conclusion, which is based on unique German regulation and directly conflicts with EU competition law consumer standards," said Amazon.de's Country Manager Rocco Brauniger, in an email to MT Newswires. "As a result of this decision, Amazon would be the only retailer in Germany forced to promote uncompetitive prices to customers, which makes no sense for customers, selling partners, or competition."

Brauniger said Amazon will appeal the "unprecedented regulatory outcome."

The German Federal Cartel Office ordered Amazon to pay a 59 million euros 'profit disgorgement' for alleged price fixing on the German Amazon Marketplace.

"In future, Amazon may use mechanisms to control seller prices only in exceptional cases, particularly in instances of excessive pricing, and in accordance with requirements set by the Bundeskartellamt," the German regulator said.
