Amgen (AMGN) won a preliminary injunction to prevent Colorado state from imposing price caps on the company's rheumatoid arthritis drug, Enbrel, according to the text of the court ruling promulgated Wednesday.
According to the decision, Amgen would likely face significant and irreparable harm from charging lower prices.
"The state's interest in helping citizens afford Enbrel is legitimate, and it has a number of ways to try to do so," the ruling read. "But one way it cannot do so under the binding precedent of the Federal Circuit, is by capping the price of a patented drug."
