Rivian Automotive Sues US for Refund of Tariffs After Supreme Court Ruling

Rivian Automotive (RIVN) filed a lawsuit in the US Court of International Trade seeking refunds of tariffs it paid under the International Emergency Economic Powers Act after the US Supreme Court ruled the levies were unlawful, according to a Thursday court filing.

The electric-vehicle maker is asking the court to declare the IEEPA tariffs unlawful as applied to Rivian and to order US Customs and Border Protection to refund all such tariffs it has paid, plus interest.

Rivian said a separate lawsuit is necessary because importers that previously paid the tariffs are not guaranteed refunds following the Supreme Court's February ruling unless they obtain their own judicial relief.

The complaint also seeks an order requiring CBP to reliquidate entries assessed with IEEPA tariffs, along with attorneys' fees and other relief the court deems appropriate.
