ICE Arrests Captain of Deadly Capsize in New York Harbor

The captain of an overloaded boat that capsized in New York Harbor earlier this month, killing a 27-year-old woman and her 5-month-old infant, has been arrested by federal authorities and faces deportation.

Manuel Ernesto Hernandez-Umana, originally from El Salvador, was facing federal charges of misconduct and neglect of a ship officer resulting in death before he was arrested by Immigration and Customs Enforcement, the Department of Homeland Security said on Wednesday.

A Coast Guard investigation found the boat was overloaded and didn't have any child or infant-sized life jackets when it capsized near the Statue of Liberty at around 10.20 p.m. ET on Aug. 8, according to court documents.

Three hours into the tour, investigators alleged Hernandez-Umana attempted to speed through swell during a U-turn and swamped the bow. This caused the boat to capsize, resulting in all 14 people being thrown overboard. The boat's maximum capacity was 10 people.

Immigration authorities claimed Hernandez-Umana allegedly lied about being a U.S. citizen to cross the southern border illegally through Texas in 2017.

"Once he faces justice for his crimes, we will make sure that he is swiftly removed from our country," Homeland Security Secretary Markwayne Mullin said.

Hernandez-Umana's lawyer, Amy Gallicchio, declined to comment.
