Alphabet's Google Must Face $3.2 Billion Publisher Ad-Tech Claims, Judge Rules

Alphabet's (GOOG, GOOGL) Google must face publisher claims seeking roughly $3.2 billion in damages for allegedly monopolizing the digital ad-tech market, a federal judge in New York ruled Wednesday, while dismissing claims by two smaller plaintiffs.

Judge P. Kevin Castel denied Google's summary judgment motions against Gannett, Daily Mail owner Associated Newspapers, a class of publishers that sold ads on Google's AdX exchange, and Mikula Web Solutions. Claims by The Progressive and Inform were dismissed.

A class of about 5,000 publishers can pursue about $1.72 billion in damages from Google. In separate suits, Gannett, now known as USA Today (TDAY), seeks about $900 million, and the Daily Mail owner sued for $600 million.

The plaintiffs allege Google monopolized the publisher ad server and ad exchange markets and unlawfully tied its AdX exchange to its DoubleClick for Publishers ad server.

Castel also dismissed Gannett's and Daily Mail's New York consumer-protection claims.

Google, Associated Newspapers and USA Today did not immediately respond to requests for comment from MT Newswires.

Alphabet shares fell 1.5% in Thursday trading, and USA Today rose 9.6%.
