Local Court Hearing Serves as a Warning to Keep Drone Operations Within Legal Boundaries

This initiative aims to educate residents and businesses involved in the low-altitude economy about the legal consequences of illegal drone activities, as such incidents become more frequent.

The defendant, identified as Xue, openly expressed regret for his actions. "I only thought about making money by modifying and unlocking drone no-fly zones. I never realized it would violate criminal law. Now I deeply regret it and am willing to accept legal punishment," he stated during the hearing. The courtroom was filled with district political advisors, lawmakers, representatives from the low-altitude economy sector, and local community members, all gathered to witness a trial involving a new type of cybercrime related to drones.

Identifying the Illegal Technology Hidden Behind Repair Services

Drone "cracking" refers to the use of illegal technical methods to bypass the built-in safety measures in a drone's flight control system, such as no-fly zone and altitude restrictions. This allows the drone to fly in restricted areas or at unauthorized heights. Since drones have the capability to process data automatically, they are legally considered a computer information system. Bypassing the device's security mechanisms violates national laws regarding the protection of computer information systems.

The rapid growth of the low-altitude economy has led to a black market for drone cracking. This underground industry includes technology providers, intermediaries, and end-users. The defendant, Xue, operated as a "technology provider" in this chain. From May 2025 until his arrest, Xue ran an online store on a major e-commerce platform, offering repair and cracking services for a specific brand of drone. He would purchase unlocking certificate programs for the corresponding drone models from overseas websites. He then remotely installed these programs into the drone's firmware to bypass the manufacturer's original security restrictions, allowing the drone to fly without altitude or no-fly zone limits. In total, Xue collected over 17,000 yuan for these services, netting an illegal profit of more than 9,000 yuan.

Courtroom Highlights the Intersection of Law, Reason, and Justice

This case is a novel type of cybercrime in the low-altitude economy sector. The Minhang District Procuratorate actively guided the investigation, given the challenges of evidence collection and the complex technical nature of the case. They collaborated with the drone manufacturer and technical experts to analyze the core functions of the two software programs used, precisely defining their illegal nature. They also directed the police to gather comprehensive evidence, including transaction records and chat logs, to build a solid case against Xue, who initially claimed his drones were lost or denied purchasing the cracking services.

During the trial, the prosecutor questioned Xue and presented evidence, including online store sales records, records of the unlocking certificate purchases, and expert analysis of the software's functions. This evidence clearly showed how Xue had been providing paid cracking services under the guise of offering repairs. Faced with the overwhelming evidence, Xue and his defense lawyer did not contest the charges.

The prosecutor argued that Xue's actions violated Article 285, Paragraph 3 of the Criminal Law of the People's Republic of China. The court agreed with the charges and the sentencing recommendation, finding Xue guilty of providing programs for illegally accessing computer information systems. He was sentenced to six months in prison, suspended for one year, and fined 2,000 yuan.

Using the Case to Build a Stronger Legal Defense for Low-Altitude Safety

The prosecutor highlighted the serious social harm of drone cracking. "No-fly zones and altitude limits are in place to ensure airspace safety and public interest. A cracked drone escapes airspace supervision and can fly into sensitive areas like airport buffer zones, military zones, government buildings, busy commercial districts, and schools. This can easily cause air interference, falling objects, collision injuries, and pose a major threat to public safety and order," the prosecutor stated.

The prosecutor used the open trial as a warning for smart device manufacturers. They were reminded to continuously improve their product security systems and to strictly adhere to legal boundaries in their research and operations, respecting the security of others' computer systems. Online platform companies were also urged to take responsibility by establishing effective review mechanisms to prevent the spread of illegal cracking services. The message for all market participants was clear: treat network and data security as a lifeline, obey the law, and do not purchase or use illegal cracking services. The public was encouraged to report any suspicious activity.

The Minhang District Procuratorate stated it will continue to focus on supporting the high-quality development of the aerospace industry. It will deepen its actions to protect the business environment, strengthen its collaboration with the district's commerce federation and other groups, and work to ensure the effective operation of its aviation economy legal service station. The goal is to provide strong legal protection for the district's efforts to build an aerospace industry hub and plan for future industries in the "15th Five-Year Plan" period.
