Attempting to flee abroad to evade debt? This strategy fails to work.

According to a report from Tianjin Daily, many enforcement cases face a common challenge: the debtor has no assets under their name, leaving the case at a standstill. Recently, the Binhai New Area Court effectively utilized entry and exit records to impose a travel ban on a debtor attempting to leave the country to avoid paying debts. This action compelled the debtor to repay the full amount the following day, upholding judicial authority and protecting the rights of the parties involved.

In this case, the applicant Wang and others initiated enforcement proceedings against the debtor Li over ownership disputes. Initially, the enforcement judge conducted extensive checks but found no seizable assets under Li's name, leading to a stalemate. While investigating leads, the judge relied on cross-departmental information feedback, which revealed multiple entry and exit records for Li during the enforcement period. Based on evidence from the applicant, Li's involvement in foreign trade, and a high frequency of outbound travel needs, the judge determined that Li planned to leave the country again soon. In accordance with the law, the Binhai New Area Court legally imposed a travel ban on Li.

Shortly after, when Li arrived at the airport to board a flight abroad, border control officials, upon checking the court's travel ban record, intercepted him on the spot. Unable to leave the country, Li contacted the enforcement judge to request the removal of the travel restrictions. The judge explained the legal consequences of refusing to fulfill debt obligations and attempting to evade enforcement, stating that the travel ban would only be lifted after full repayment of the debt. Following patient legal guidance, Li acknowledged his legal responsibilities and voluntarily requested the court to organize repayment negotiations between both parties. Under the judge's mediation, an enforcement settlement was reached, with Li promising to repay the entire debt within two days. The day after the agreement, Li fully paid all outstanding amounts, successfully concluding the ownership dispute case and fulfilling the victorious party's rights.

Many people mistakenly believe that if the court cannot find property, vehicles, or deposits, enforcement cannot proceed. In reality, the court's enforcement measures are continuously improving. According to a judge from the Tianjin Higher People's Court, based on Article 266 of the Civil Procedure Law of the People's Republic of China, if a debtor fails to fulfill obligations under an effective legal document, the court can not only impose a travel ban but also record the dishonest information in credit files, expose it through media, and even implement judicial detention when necessary. Any attempts to evade debt through asset transfers, identity changes, or fleeing abroad are futile under the law.
