A significant legal development emerged on August 14 local time, as the U.S. Court of Appeals for the District of Columbia Circuit ruled that a lower court must reconsider the case involving DJI's placement on the Pentagon's "Chinese military company" blacklist. This decision marks a key procedural win for DJI in its multi-year legal battle within the United States.

The company was first added to the Pentagon's list of "Chinese military companies" in October 2022, a designation it has repeatedly contested and publicly opposed. After failing to resolve the issue through administrative appeals, DJI formally filed a lawsuit in October 2024 with the U.S. District Court for the District of Columbia. A lower court initially ruled in favor of the Pentagon in 2025, prompting DJI to appeal.

In its latest decision, the appellate court focused on the core question of whether DJI contributes to China's defense industrial base. The court determined that the lower court's review was flawed and lacked sufficient evidence, and it sent the case back for a fresh examination. The new review will include an assessment of classified documents before determining whether DJI should remain on the CMC list.

Since its erroneous blacklisting in 2022, DJI has persistently sought legal remedies, pointing out that the Pentagon's action was taken without adequate evidence or due process, leading to significant reputational and commercial harm. In response to the appellate court's ruling, DJI stated that it welcomes the positive decision, calling it an important step toward ultimately correcting the improper listing. The company reiterated its firm opposition to the use of its products and technology for any military or warfare purposes, and affirmed its commitment to continuing legal action to protect its rights and the interests of its global users.

Despite facing numerous unreasonable policy pressures and bans in the U.S. in recent years, DJI's products and technology remain highly indispensable across American civilian sectors, including consumer markets, local law enforcement, firefighting, and agriculture. According to earlier media reports, DJI commands between 70% and 90% of the U.S. commercial drone market. More than 80% of state and local law enforcement and emergency response agencies across the country use DJI technology, and four out of every five agricultural drones in the U.S. are DJI models.

American public safety agencies are deeply reliant on DJI equipment. Numerous fire departments and police departments have indicated that DJI drones offer an absolute advantage in price, performance, and reliability, making them essential tools for local public safety and emergency response. For instance, in a May interview with the Wall Street Journal, one police department noted that DJI drones were the only affordable detection tool within their budget, while comparable American-made alternatives often cost three to five times more and still failed to match their performance.
