Texas Enacts Sweeping Ban on Most Synthetic Cannabinoid Products

Texas has implemented a new regulation targeting cannabinoid (THC) products, which officially took effect on July 31, 2026. This rule prohibits the sale and possession of the vast majority of synthetic cannabinoid derivative products across the state, with violations leading to felony charges and substantial fines.

The policy shift follows a recent ruling by the Texas Supreme Court, which lifted an injunction that had previously blocked administrative enforcement. This allows the state government to enforce regulations established by the Texas Department of State Health Services, classifying most synthetic cannabinoid products—including Delta-8, Delta-10, THCP, and THCA flower—as Schedule I controlled substances.

Prior to this change, these synthetic cannabinoid products operated in a legal gray area and were sold openly due to regulatory loopholes in the U.S. 2018 Farm Bill. Under the new rules, only Delta-9 cannabinoid products (such as specific gummies, beverages, and tinctures) with a dry-weight THC concentration of no more than 0.3% are permitted to remain legal. Additionally, Delta-9 cannabis flower that meets this THC threshold is temporarily excluded from the ban, as related litigation involving inhalable cannabis products is still pending.

Regarding legal consequences, the new regulation establishes a strict penalty system. Unlawful possession of banned cannabinoid products is classified as a state jail felony, punishable by 180 days to two years in prison and fines up to $10,000. For businesses that illegally sell these products, regulatory authorities will revoke their operating licenses, pursue criminal prosecution, and impose heavy fines.

Texas law clearly stipulates that recreational cannabis remains illegal in the state. The state only operates a highly limited medical cannabis program, with strict criteria for eligible conditions and product forms. It permits only designated doctors to prescribe non-inhalable oral medications with a THC concentration not exceeding 0.5% to patients with specific severe conditions, such as epilepsy, amyotrophic lateral sclerosis (ALS), and autism spectrum disorder.
