AEM Holdings Ltd announced an update on the ongoing patent-infringement lawsuit filed by Advantest Test Solutions, Inc. in the United States District Court for the Southern District of California.
The company said the court had ruled on Jun, 29 2026 that Advantest’s initial complaint, which alleged infringement of U.S. Patent Nos. 11,674,999 and 12,320,841, was inadequately pleaded. Advantest subsequently submitted a First Amended Complaint. AEM responded with a motion to dismiss, and on Sep, 23 2026 the court vacated the scheduled hearing, indicating it would decide the motion based solely on written submissions. A decision is still pending.
Separately, AEM has filed petitions for inter partes review with the United States Patent Trial and Appeal Board to challenge the validity of the two patents cited in the lawsuit. The PTAB will decide in due course whether to institute the reviews.
Based on present information, AEM does not expect the litigation or the PTAB petitions to have a material impact on its business operations or financial position.
