WuXi AppTec Files Lawsuit in U.S. District Court to Overturn “Chinese Military Company” Designation

WuXi AppTec Co., Ltd. (HKEX: 02359) has initiated legal proceedings in the United States District Court for the District of Columbia seeking to nullify the U.S. Department of Defense’s (DoD) designation of the company as a “Chinese military company” (CMC) under Section 1260H of the National Defense Authorization Act.

On 8 June 2026 (U.S. time), the DoD added WuXi AppTec to its updated CMC list. The company publicly rejected the classification on 9 June and, on 11 June, filed a formal complaint requesting the court to: 1. Declare the CMC designation “null, void and with no force and effect”; 2. Vacate and set aside the designation; and 3. Remove WuXi AppTec from the Section 1260H list.

Management emphasized that the designation is “erroneous and unsupported by the facts or legal criteria” and affirmed that existing operations with global pharmaceutical and life-science partners will continue without disruption. The board reiterated the company’s mission to enable the development of life-saving therapies worldwide.

WuXi AppTec stated that further material developments related to the litigation will be disclosed through additional announcements. The company cautioned shareholders and potential investors to exercise prudence when dealing in its securities.
