Federal Government Sues Wisconsin as Jurisdictional Battle Over Prediction Markets Intensifies

The U.S. Commodity Futures Trading Commission (CFTC) has officially filed a lawsuit against the state of Wisconsin, asking a federal court to rule that the state lacks the authority to halt prediction market platforms under its gambling statutes. This is the latest in a series of recent legal actions taken by the CFTC against multiple states, signaling an escalation in the heated dispute over regulatory control of the novel financial product known as "event contracts."

The conflict began when the Wisconsin Attorney General, Josh Kaul, filed a civil lawsuit last week accusing five federally regulated prediction market platforms—including Kalshi, Polymarket, Crypto.com, Robinhood, and Coinbase—of "openly promoting illegal sports betting" across the state. Kaul stated, "No matter how cleverly packaged, the law does not permit companies to operate gambling businesses in disguise through so-called 'event contracts'."

Prediction markets allow users to place bets on "yes/no" outcomes of future events, such as election results, sports competitions, or climate data. While platform operators argue these are legitimate, federally regulated hedging tools, Wisconsin contends they violate state law, which permits sports betting only within tribal casinos.

In response to the state's action, the CFTC, together with the Department of Justice, launched a countermove on April 28, seeking an injunction to block Wisconsin’s enforcement efforts.

The CFTC Chair emphasized that Congress delegated exclusive regulatory authority over derivatives, including event contracts, to the federal government decades ago. The Chair warned, "States cannot circumvent the clear directives of Congress. If you attempt to interfere with federal oversight of financial markets, we will take you to court."

This dispute highlights a deepening rift within the U.S. financial regulatory system. As 11 tribal nations and state governments pass new laws to advance online sports betting, the redistribution of the multi-billion dollar online gambling market is underway. The CFTC has recently filed similar lawsuits against states including New York and Arizona. With the case now entering the U.S. District Court for the Eastern District of Wisconsin, the outcome of this nationwide jurisdictional battle will have profound implications for the business models of cryptocurrency exchanges and fintech firms such as Robinhood.
