Bayer Resolves PCB Exposure Lawsuits From Washington State School

Bayer's Monsanto agreed to resolve lawsuits representing more than 200 plaintiffs who allege they were sickened by exposure to polychlorinated biphenyls at Sky Valley Education Center in Washington state.

The agreement doesn't include adverse jury decisions in nine prior cases involving 49 plaintiffs, which the company is continuing to appeal.

The terms are confidential and still subject to approval of final settlement agreements. The company said the costs of the agreements would be covered by the PCB litigation provision it established in the second quarter, which it previously said would be worth EUR 530 million.

Bayer has been the target of a string of lawsuits by students, employees and parents at the Monroe, Wash. school who say they developed cancer, thyroid problems and neurological issues as a result of exposure to PCBs made by Monsanto, which Bayer bought in 2018, in the school's light fixtures.

In January, a jury ordered the company to pay $100 million to four plaintiffs, while saying the company was not liable for injuries of 11 others. Previous awards have totaled more than $1.5 billion, but some have been overturned or reduced as Bayer continues to appeal.
