The company is urging the court to accelerate the briefing schedule, citing concerns about further loss of evidence and witness availability due to the case's lengthy duration. The proposed schedule would have opening briefs due by December 1, 2025, with oral argument to follow in March 2026 or as soon as possible thereafter. The appeal is being heard under case number 2026-1033 in the Federal Circuit.
