The lawsuit alleges that H&M's U.S. retail operations infringe five Alpha Modus patents related to shopper analytics, store layout optimization, inventory intelligence, personalized marketing, and automated checkout. Alpha Modus is seeking a jury trial, a permanent injunction to prevent further use of its patented technologies, and monetary damages, including enhanced damages for alleged willful infringement and attorneys' fees. The patents in question cover technologies for monitoring shopper behavior, analyzing product interactions, optimizing product placement, real-time inventory management, and seamless in-store purchasing. The complaint claims that H&M uses systems such as RFID garment tracking, digital video, mobile apps, inventory software, and interactive mirrors that rely on the patented methods and systems.
