Dexus Says Court Sets Oct. 20 As Hearing Date for Rest Infrastructure, Dexus Bloc Shareholder Appeals

Dexus (ASX:DXS) said a court made orders fixing a hearing date for appeals filed by both the Rest Infrastructure Trust and the remainder of the Dexus Bloc shareholders on Oct. 20, for a period of three days, according to a Wednesday Australian bourse filing.

The Dexus Bloc shareholders filed an appeal in June against a New South Wales Supreme Court ruling in May, which upheld the validity of a default notice related to a legal dispute with Australia Pacific Airports. Rest Infrastructure Trust, one of the Dexus Bloc shareholders, filed an appeal against the court decision earlier in June.

Australia Pacific Airports filed notices of cross-appeal in the Dexus Bloc appeal and Rest Infrastructure appeal, contending that, if the default notice is not valid as against the non-selling shareholders and Rest Infrastructure, it was still valid as against all other members of the Dexus Bloc, or alternatively, against the Dexus Bloc selling shareholders as defined in the judgment delivered by the New South Wales Supreme Court.
