【#公司HR假扮猎头诱导老员工辞职#】陈女士在江苏常州某药企干了6年的销售，2023年，公司以业绩不达标为由，将她从大客户经理调为了零售经理，并让她到南京公司报到，工资从上万元降到3000多，陈女士不同意并继续在常州上班。之后，公司2次以各种理由向她发出了解除劳动合同通知。此时，公司人力资源部门的工作人员冒充猎头给陈女士打电话，电话中让她描述了几段工作经历。事后，公司以电话中套取的工作经历为由，称陈女士有兼职的情形，再次要求解聘。与公司交涉无果的陈女士，无奈起诉到了法院。法院审理后认为，该药企在整个用工管理过程中存在一系列违法违规的行为。本案中公司拿不出陈女士业绩不达标的证据，还让工作人员冒充猎头公司，诱导陈女士辞职。此外，公司也没有有效的证据证明陈女士存在兼职的情况。最终，法院判决公司属于违法解除劳动合同，5日内向陈女士支付赔偿金。（荔枝新闻）
