Child's Prank with Poplar Floss Leads to 110,000 Yuan Compensation for Parents

A recent court case in Pinggu District has concluded with parents being ordered to pay over 110,000 yuan in compensation after their minor child ignited poplar floss, causing a fire. The incident serves as a critical safety reminder for families during the season when poplar and willow floss is prevalent. Parents are urged to strengthen safety education for their children and strictly prohibit any fire-related play.

In May of last year, a minor identified as Xiaoqi, motivated by curiosity and playfulness, used a lighter to set fire to an accumulation of poplar floss behind their home. Due to the highly flammable nature of the material, the flames spread within seconds to a neighboring contracted plot of land, damaging trees and fencing. After the incident, the two parties failed to reach a compensation agreement, leading the neighbor to sue Xiaoqi and the parents, seeking over 300,000 yuan for property damages.

The court determined that Xiaoqi's act of igniting the poplar floss was the direct cause of the fire, establishing a clear causal link to the neighbor's property loss. As Xiaoqi was under 15 years old at the time of the incident, and thus a person with limited civil capacity, the legal responsibility for the damages fell upon the parents. Following a site inspection, the court confirmed that 251 trees and 70 sections of fencing were damaged by the fire. The compensation amount was set based on local market values.

The court ultimately ruled that Xiaoqi's parents must pay over 110,000 yuan in compensation to the neighbor, a judgment which has now taken effect. Judicial authorities noted that fires sparked by the ignition of poplar floss occur almost every year, with statistics from relevant departments indicating that children and adolescents are most often responsible. While minors may lack full civil capacity due to an inability to fully comprehend their actions, this does not exempt them or their guardians from liability for damages. If a minor possesses personal assets, compensation may be paid from those resources.

The court further emphasized that spring is the peak season for floating poplar floss and a high-risk period for related fires. Given the material's extreme flammability and the difficulty in controlling such fires, ignition can easily lead to irreversible losses. The public is strongly advised to enhance their safety awareness and avoid complacency. Parents, in particular, must diligently fulfill their supervisory and educational duties, providing clear instruction on fire safety and strictly warning children against lighting poplar floss or playing with lighters and matches. Residents are also encouraged to promptly clear accumulations of poplar floss from their doorsteps and yards to eliminate potential fire hazards.
