Former Senior Executive of COSCO Group Sentenced for Corruption and Embezzlement in Shanghai Court

A Shanghai court has publicly announced the first-instance judgment in the case of Sui Jun, a former senior executive under the direct management of the Party Leadership Group of China COSCO Shipping Group, for accepting bribes and misappropriating public funds. The Shanghai First Intermediate People's Court (Shanghai First Intermediate Court) sentenced the defendant, Sui Jun, to ten years and six months in prison for the crime of accepting bribes, along with a fine of one million yuan. For the crime of misappropriating public funds, he was sentenced to five years and six months in prison. The combined sentence is twelve years and six months in prison, with a fine of one million yuan. Illegal gains and profits are to be recovered.

The court found that from 1999 to 2022, the defendant, Sui Jun, exploited his positions of authority and the influence derived from his roles. These included serving as General Manager of Dalian COSCO Container International Freight Agency Co., Ltd., General Manager of COSCO Northern Logistics Co., Ltd. (referred to as Northern Logistics), General Manager of COSCO Container Transport Dalian Co., Ltd., Deputy General Manager of COSCO Container Lines Co., Ltd., and Deputy General Manager of COSCO Shipping Lines Co., Ltd. He directly or indirectly, through the actions of other state functionaries, provided assistance to others in areas such as ship agency business, transportation operations, securing employment for relatives, and project contracts, thereby seeking benefits for them. In return, he illegally accepted property equivalent to more than 10.15 million yuan.

In October 2004, Sui Jun, leveraging his position as General Manager of Northern Logistics, accepted requests from others and, concealing the true purpose of the funds, loaned public funds amounting to over 17.77 million yuan to a related company for its business operations, seeking personal gain. From November 2005 to January 2006, Northern Logistics gradually recovered the aforementioned funds.

The Shanghai First Intermediate Court determined that the defendant Sui Jun's actions constituted the crimes of accepting bribes and misappropriating public funds. The amount of bribes accepted was particularly large, and the misappropriation of public funds was serious, warranting punishment according to law. Considering factors such as Sui Jun's admission of guilt and the recovery of illegal gains, the court imposed a lighter sentence in accordance with the law. The court subsequently issued the aforementioned judgment.
