Local Authorities Crack Down on POP MART Trademark Infringement Case

Recently, the Haidian District Market Supervision and Administration Bureau investigated and penalized a retail store for selling products suspected of infringing upon the registered trademark rights of "POP MART."

Following a consumer complaint, enforcement officers arrived at the business premises of the involved merchant and discovered multiple items on the shelves bearing "POP MART" and "THE MONSTERS" labels, including blind boxes and plush keychains. These products had packaging designs and brand logos that closely resembled genuine POP MART products, but exhibited obvious issues such as crude packaging workmanship and lack of proper anti-counterfeiting marks. After professional authentication by POP MART's trademark rights holders, it was confirmed that all these products were not manufactured by the company or its authorized enterprises, constituting infringing goods.

Investigation revealed that the merchant had purchased the counterfeit products through irregular online channels and sold them at prices lower than genuine products, with total illegal sales amounting to 2,322 yuan. In accordance with relevant provisions of the Trademark Law of the People's Republic of China, the Haidian District Market Supervision and Administration Bureau imposed administrative penalties on the merchant, including confiscation of all infringing products and fines, while ordering immediate cessation of the infringement activities. The seized counterfeit goods were lawfully destroyed in a centralized manner, and leads regarding upstream production and supply units were traced back for further investigation.
