The market supervision authorities, based on laws and regulations such as the "Regulations on the Supervision and Administration of Medical Devices" and the "Measures for the Supervision and Administration of Medical Device Operations," primarily examine whether enterprises have obtained medical device business licenses or completed necessary filings; whether they are dealing with unregistered or unfiled medical devices, or those lacking proper certification; whether they have arbitrarily changed business premises, scope, methods, or warehouse addresses; whether they are handling medical devices with non-compliant instructions or labels; and whether they are sourcing medical devices from suppliers without legitimate qualifications. The tax authorities focus on tax-related risk points within the medical device industry, specifically investigating whether enterprises issue invoices in accordance with regulations and whether there are instances of fraudulent value-added tax invoice issuance.
During the inspections, law enforcement officers simultaneously enforce regulations, provide legal education, and conduct awareness campaigns. They patiently explain relevant laws, regulations, and policies concerning medical devices and taxation to enterprises, guiding them to foster a consciousness of lawful operation and honest tax payment.
