As the year-end approaches, the South Gate Market Supervision Office under the Taishan District Market Supervision Administration in Tai'an City, Shandong Province, has received multiple complaints regarding improper promotion of medical devices. To strengthen the safety barrier for medical devices, the office recently launched a comprehensive special inspection and targeted legal education campaign across its jurisdiction. Investigations revealed that while some unscrupulous merchants did mislead consumers with false advertising about medical devices, the majority of complaints were filed by professional claimants exploiting discrepancies between promotional materials and filed information to seek improper gains.
During the special operation, law enforcement officers focused on key venues such as medical device retail stores and health experience centers within their jurisdiction. They conducted detailed checks centered on core aspects, including the consistency between promotional content and filed information, and the compliance of advertising approval numbers. The inspection uncovered issues at some business units, such as promotional language exceeding the approved scope of use and failure to label advertising approval numbers as required, with these problems being most prevalent in popular categories like physiotherapy equipment and rehabilitation devices.
Law enforcement personnel issued on-the-spot orders for rectification. For minor violations, they adopted a "no penalty for first offense" approach, providing on-site guidance in accordance with the relevant provisions of the "Measures for the Supervision and Administration of Medical Device Operations." For cases suspected of involving false advertising, they initiated investigations according to the law, resolutely curtailing the profit-seeking opportunities for professional claimants. Simultaneously, a "supervision + legal education" model was promoted, carrying out multi-dimensional legal publicity campaigns.
Through methods such as organizing specialized training sessions for business unit managers, distributing compliance guidance manuals, and posting warning posters, the campaign focused on interpreting the core requirements concerning promotional filings in the "Advertising Law" and the "Regulations on the Supervision and Administration of Medical Devices." It clarified that business units must ensure complete consistency between advertising content and registered/filed information, and must not include prohibited statements such as efficacy assertions or cure rate guarantees. Addressing the susceptibility of elderly consumer groups to being misled, law enforcement officers set up consultation desks in communities and shopping centers, providing on-site explanations of device selection knowledge and rights protection channels.
In the next phase, the South Gate Market Supervision Office will establish an "information database for professional claimants" to accurately identify abnormal complaints and reports, thereby improving handling efficiency. It will deepen inter-departmental collaboration, establishing an information-sharing mechanism with public security and judicial departments to jointly combat illegal activities such as extortion. The office will also conduct regular "look-back" inspections, specifically tracking the implementation of rectifications by businesses to prevent problems from recurring. Furthermore, it will continue to optimize legal education services, using online micro-courses and case analysis to enhance the compliance awareness of business units, aiming to reduce violations and illegal activities at the source.
