BlockBeats 消息，11 月 7 日，美国证券交易委员会 (SEC) 要求加利福尼亚北区地方法院驳回 Kraken 针对加密货币交易平台非法行为的指控提出的三项辩护。在 11 月 5 日提交的动议中，监管机构驳回了 Kraken 有关证券法不明确及其如何适用于虚拟资产的指控，以及该交易所没有得到公平通知表明其行为被视为违反证券法的断言。
它还要求法院驳回 Kraken 的“重大问题原则”辩护。该原则是最高法院确立的一项法律原则，规定机构不得在未经国会明确授权的情况下扩大其监管权力。
2023 年 11 月，SEC 起诉 Kraken 以未注册的证券交易所、经纪商、交易商和清算机构的身份运营平台。SEC 表示，它认为自 2018 年 9 月以来，Kraken 通过协助加密资产证券的买卖非法赚取了数亿美元。Kraken 申请驳回此案，该动议于 8 月被驳回。
