【上海法院对全国首例私募"FOF基金"场外配资案宣判】金十数据11月19日讯，上海市第一中级人民法院一审公开宣判全国首例以所谓私募“FOF基金”形式提供场外配资，非法经营证券融资业务案件，以非法经营罪对被告人李某判处有期徒刑六年，并处罚金人民币六百万元；对被告人蒋某判处有期徒刑五年六个月，并处罚金人民币五百五十万元；对被告人葛某判处有期徒刑一年九个月，并处罚金人民币一百万元。上海一中院审理后认为，被告人李某、蒋某，伙同被告人葛某等人，违反国家规定，非法经营证券业务，扰乱市场秩序，已构成非法经营罪，情节特别严重。
