German National Building Illegal Villa on Bali Farmland Named Suspect

TEMPO.CO, JakartaBali Police have charged AF, a 53-year-old German citizen, with illegally converting agricultural land for the construction of a villa. Police Chief Inspector General Daniel Adityajaya stated that AF built the villa without the necessary permits on protected rice fields and designated agricultural land, which falls under the food crop zone (P1), located on Jalan Sri Wedari in Ubud, Gianyar.

“The suspect's actions involved the construction of a villa, a spa center, and a livestock farm,” he explained in an official statement released on Tuesday, January 28, 2025. The investigation into this case was initiated following a police report filed on November 25, 2024. The land in question covers an area of 1.8 hectares.

AF is the Director at PT. Parq Ubud Partners, PT. Tomorrow Land Development Bali, and PT. Alfa Management Bali.

Chief Daniel revealed that 28 witnesses have been interviewed during the investigation. Police records indicate the existence of 34 land ownership certificates (SHM). An investigation revealed that the construction of villas and spas owned by AF extends beyond zone P1, encroaching into both the plantation zone (P3) and the tourism zone.

AF's actions have resulted in a reduction of agricultural land in Bali. Consequently, AF faces charges under Article 109 in conjunction with Article 19 paragraph (1) of Law Number 22 of 2019 concerning the Sustainable Agricultural Cultivation System, as amended by Law Number 6 of 2023 on Job Creation.   

He also faces charges under Article 72 in conjunction with Article 44 paragraph (1) of Law Number 41 of 2009 concerning the Protection of Sustainable Food Agricultural Land, as amended by Law Number 6 of 2023 on the stipulation of government regulations in lieu of law Number 2 of 2022 on Job Creation.
