Federal Court Rules Orica Failed to Pay Coal Mining Industry Long Service Leave Funding Levies on Certain Eligible Wages

Orica (ASX:ORI) failed to pay the Coal Mining Industry Long Service Leave Funding levies imposed by law on eligible wages paid to all of its employees who performed shotfiring and related services at black coal mines in New South Wales, Australia's federal court ruled in a Thursday judgement.

It added that employees of Orica who performed shotfiring and related services at black coal mines in New South Wales during the period from March 1, 2013, to Feb. 28, 2022, were eligible employees.

In a May 15 judgement, the court resolved partly to allow Orica's appeal and asked the parties to provide an agreed minute or competing minutes of orders proposed to give effect to them. However, such an agreement was not reached.

The court also said each party should bear its costs for the proceedings.
