BlockBeats 消息，7 月 24 日，据 TheBlock 报道，第九巡回上诉法院就 Bored Ape 发行商 Yuga Labs 与艺术家 Ryder Ripps 之间的长期案件做出了混合裁决，Ryder Ripps 此前故意将 NFT 的复制品作为“表达性挪用艺术”出售。
法院认定 NFT 是可以获得商标保护的“商品”，并驳回了 Ripps 的许多法律论点，但撤销了先前针对 Ripps 的 800 万美元判决，并将案件发回下级法院审理，要求下级法院重新审理 RR/BAYC 是否造成消费者混淆的问题。该案始于 2022 年 6 月，Yuga Labs 指控 Ripps 通过发行 RR/BAYC 系列 NFT 贬损其品牌价值。法院驳回了 Ripps 关于“表达性艺术”和宪法第一修正案保护的抗辩，但认为需要进一步证据证明造成消费者混淆问题的可能性。
