Northern Dynasty Minerals (NAK) said Monday that it has filed a summary judgement brief in Alaska Federal Court challenging the Environmental Protection Agency's veto of its Pebble project, and the State of Alaska, Iliamna Natives and Alaska Peninsula Corp did as well.
The company said EPA has made it impossible to mine the deposit even though Congress specified that the state lands in which Pebble is located should be available for mining.
The EPA also "significantly underestimated" the negative impact of the cost its veto imposes on the economies of Alaska and the US, the company said.
Northern Dynasty shares rose 4.9% in premarket trading.
