Auckland International Airport Says High Court Denies Judicial Review Relating to Commerce Commission Process

Auckland International Airport (NZE:AIA, ASX:AIA) says the high court has dismissed the judicial review brought by Air New Zealand (NZE:AIR, ASX:AIZ), Qantas Airways (ASX:QAN), and the Board of Airline Representatives New Zealand against the Commerce Commission's airport services input methodologies amendment determination, according to a Thursday filing with the New Zealand and Australian bourses.

The dispute centers on the Commerce Commission's 2023 update to airport input methodologies, which changed how the cost of capital is calculated, with airlines arguing it could drive higher charges for passengers and airports seeking to ensure a fair return on their infrastructure investments.

The court rejected the airlines' claims, ruling that technical errors in the airport services cost of capital will be addressed in the ongoing merits review appeal by regulated airports and the New Zealand Airports Association in February 2024, per the filing.

The company is now awaiting the high court's decision on that appeal, the filing added.
