【#深圳一公司让员工PK业绩定单双休#】#员工PK业绩胜者大小周负者单休# 1月13日,有求职者称深圳一公司招聘客服,同岗位的人分为两组PK工作数据,获胜的组次月按“大小周”休息(一周双休另一周单休),输的组则每周都是单休。据了解,该公司为深圳市明星旺塑业有限公司。1月15日,极目新闻记者以求职者身份咨询该公司客服岗位HR,对方称确实是以PK的方式决定大小周,“因为目前人手不足,暂时还没有双休,之后可能会有。”HR表示,工作数据考核的是线上成交转化率、精准转化率、分配转化率、分配成功转化率等,工资构成为底薪4500+绩效奖金+PK奖金+okr激励奖金,综合薪资在6000元至7000元。记者询问,考核数据输的一组是不是单休,同时没有PK奖金,对方表示“是的”。河南泽槿律师事务所主任付建认为,根据《劳动法》44条规定,单休如果没有补休,应当支付正常工资2倍的报酬;公司若以PK失败为由扣除单休组的奖金,没有法律依据。“无论哪种休假模式,只要涉及‘休息日工作’,都需要补休或付2倍加班费。”付建表示。(极目新闻)
