【#深圳一公司让员工PK业绩定单双休#】#员工PK业绩胜者大小周负者单休# 1月13日，有求职者称深圳一公司招聘客服，同岗位的人分为两组PK工作数据，获胜的组次月按“大小周”休息（一周双休另一周单休），输的组则每周都是单休。据了解，该公司为深圳市明星旺塑业有限公司。1月15日，极目新闻记者以求职者身份咨询该公司客服岗位HR，对方称确实是以PK的方式决定大小周，“因为目前人手不足，暂时还没有双休，之后可能会有。”HR表示，工作数据考核的是线上成交转化率、精准转化率、分配转化率、分配成功转化率等，工资构成为底薪4500+绩效奖金+PK奖金+okr激励奖金，综合薪资在6000元至7000元。记者询问，考核数据输的一组是不是单休，同时没有PK奖金，对方表示“是的”。河南泽槿律师事务所主任付建认为，根据《劳动法》44条规定，单休如果没有补休，应当支付正常工资2倍的报酬；公司若以PK失败为由扣除单休组的奖金，没有法律依据。“无论哪种休假模式，只要涉及‘休息日工作’，都需要补休或付2倍加班费。”付建表示。（极目新闻）
