德国生物制药公司BioNTech周四在特拉华州联邦法院起诉Moderna，指控Moderna的新冠疫苗 mNEXSPIKE侵犯了BioNTech和辉瑞公司的竞争性疫苗Comirnaty的相关专利。

　　该诉讼称，Moderna公司于2025年获得美国食品药品管理局批准的下一代新冠疫苗mNEXSPIKE，侵犯了BioNTech公司在用于简化mRNA疫苗设计的技术方面的权利，该技术允许以较低剂量为患者接种。

　　Moderna在2022年起诉BioNTech及其合作伙伴辉瑞公司侵犯了Comirnaty的专利权，目前诉讼仍在进行中。这些案件是生物技术公司为重磅疫苗所用技术寻求专利使用费而发起的专利诉讼浪潮中的一部分。

　　Moderna公司发言人表示，该公司将针对BioNTech公司的诉讼进行辩护。

　　辉瑞公司的发言人也没有立即发表评论，该公司没有直接参与诉讼。

　　BioNTech在诉讼中称，mNEXSPIKE预计将占Moderna公司新冠疫苗收入的55%，直至2025-26年呼吸道病毒季节。

　　新冠疫苗收入自大流行高峰期以来急剧下降，当时Moderna的Spikevax和辉瑞以及BioNTech的Comirnaty为公司带来了数十亿美元的收入。在美国总统特朗普任命疫苗怀疑论者小罗伯特·肯尼迪为卫生部长后，疫苗收入也普遍下滑。
