揭阳市市场监督管理局公布2026年第五期典型案例（九）

案例十一

揭阳市某电子商务经营部涉嫌在网络销售医疗器械未按照规定展示医疗器械注册证和未办理变更登记超出核准经营范围经营医疗器械案

2025年3月，揭东区市场监督管理局根据移送线索，依法对揭阳市某电子商务经营部涉嫌在网络销售医疗器械未按照规定展示医疗器械注册证和未办理变更登记超出核准经营范围经营医疗器械的行为予以立案调查。经查，当事人在线下门店和某平台上同步销售经营医疗器械避孕套产品，在某平台上未按照规定展示《中华人民共和国医疗器械注册证》信息，且该店《营业执照》核准经营范围不包含医疗器械。当事人的行为违反了《医疗器械网络销售监督管理办法》第十条的相关规定。

2025年4月，揭东区市场监督管理局依据《中华人民共和国行政处罚法》第五条第二款、《医疗器械网络销售监督管理办法》第四十条有关规定，责令当事人改正违法行为，并对其作出警告的行政处罚。
