ARN Media (ASX:A1N) said Jacqueline Henderson and her related companies started legal proceedings against the company in the Federal Court, claiming compensation of at least AU$82.3 million as well as the payment of a pecuniary penalty, plus interest and costs, according to a Tuesday Australian bourse filing.
The proceedings were filed against the company and its unit, Commonwealth Broadcasting, which is the license holder for KIIS 1065 Sydney, and which contracted with Henderson and her services company.
The company took the "Kyle and Jackie O" show off air following a dispute between co-hosts Jacqueline Henderson and Kyle Sandilands, and later ended its partnership with Sandilands and Quasar Media, citing serious misconduct during a February broadcast that breached its services agreement, according to an earlier bourse filing.
Sandilands and his related companies began legal proceedings against the company earlier.
The applicants claim the termination of Henderson's contract constituted adverse action, the Tuesday filing showed. Henderson sent a complaint letter to Commonwealth Broadcasting noting that Henderson "cannot continue to work" with Sandilands and made psychosocial health and safety and bullying complaints in relation to Sandilands' conduct. The sending of the letter involved the exercise of workplace rights, and Henderson's contract was terminated because of this exercise, the applicants allege.
ARN said it disputes the claims and plans to defend the proceedings.
ARN Media's shares declined 3% in recent trading on Tuesday, hitting an all-time low.
